These Terms of Service (“Terms”) govern your access to and use of the Gemma mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
Platform terms: Where applicable, your use of the App is also subject to Apple’s standard End User License Agreement (EULA).
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the Service.
You must sign in using Apple or Google (or other methods we may offer). You are responsible for:
Maintaining the confidentiality and security of your account
All activity that occurs under your account
You agree to provide accurate information and keep it up to date.
Gemma helps users discover restaurants, create lists (including with friends), follow others, and post reviews and photos.
The Service is currently free. We may introduce paid features later. If we do, we will provide notice and any additional terms that apply.
“User Content” includes text, images, lists, and other materials you submit or display through the Service.
You retain ownership of your User Content. By submitting User Content, you grant Gemma a worldwide, non-exclusive, royalty-free, transferable (to service providers), sublicensable license to host, store, reproduce, display, distribute, and make technical modifications (e.g., resizing/formatting) solely to operate, improve, and promote the Service.
You represent and warrant that:
You have all rights needed to post your User Content, and
Your User Content does not violate laws or third-party rights (including privacy, publicity, and intellectual property rights).
The Service is intended to be private by default, with a limited public profile.
Your name
Your city
Your profile photo
Your User Content, including reviews, photos, and lists (including collaborative lists)
Other social activity related to your account within the Service (as applicable)
Other users may request to follow you. You can approve or reject follower requests in the App. You are responsible for what you share with approved followers. We do not control what approved followers do with information they can access within the Service.
You agree not to:
Harass, bully, threaten, or encourage violence or hate
Post unlawful, defamatory, or infringing content
Impersonate others or misrepresent your identity
Attempt to sabotage, disrupt, hack, or misuse the Service
Upload malware or attempt unauthorized access
Manipulate reviews, rankings, or engagement through spam or fake accounts
We may remove content, restrict features/visibility, suspend, or terminate accounts that violate these Terms or pose risks to others.
We may (but are not obligated to) monitor and moderate content. We may remove or restrict content at our discretion, especially to enforce these Terms, protect users, and comply with law.
The Service may include or rely on third-party services (e.g., maps) or third-party content. Restaurant information may be inaccurate or outdated. Gemma is not responsible for third-party services, restaurants’ offerings, or your interactions with third parties.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMMA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMMA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMMA’S TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED (A) USD 50 OR (B) THE AMOUNT YOU PAID TO GEMMA IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (WHICHEVER IS GREATER). (CURRENTLY, YOU PAY NOTHING.)
Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the maximum extent permitted.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required for security, or if required by law. Sections that by their nature should survive termination will survive (including disclaimers and limitation of liability).
We may update the Service or these Terms from time to time. If changes are material, we will provide reasonable notice (for example, via the App or Website). Continued use after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction apply.
Disputes shall be resolved in Swedish courts, unless mandatory laws require otherwise.
